01Acceptance of these terms

By accessing or using kevindownswell.com (the “site”), you agree to these Terms of Use and to our Privacy Policy. If you do not agree, please do not use the site. In these terms, “we”, “us” and “our” refer to Kevin Downswell Ministries.

02Use of the website

The site is provided for your personal, non-commercial use, to learn about Kevin Downswell’s music, ministry, live work, books and related activity, to join the Inner Circle, and to submit booking requests.

We may change, suspend or discontinue any part of the site at any time, and we do not guarantee that the site will always be available or error-free.

03Intellectual property

All content on the site is owned by Kevin Downswell Ministries or by Kevin Downswell, or used with permission, and is protected by copyright, trademark and other laws. This includes, without limitation:

• music, recordings and audio;
• images, photographs and video;
• written content, including biography, devotional and descriptive text;
• the design, layout and graphics of the site;
• the name “Kevin Downswell”, the “KD” monogram, and related logos and branding.

You may view the site and share links to it. You may quote brief extracts of text with clear attribution where the law allows. You may not otherwise copy, reproduce, download, distribute, publicly perform, adapt, or create derivative works from any content on the site, and you may not use the Kevin Downswell name, monogram or branding, without our prior written permission.

04Acceptable use

When using the site, you agree not to:

• use it in any way that breaks the law or infringes the rights of others;
• attempt to gain unauthorised access to, interfere with, or disrupt the site or the systems that support it;
• introduce malware or any other harmful code;
• scrape, harvest or collect data from the site by automated means;
• submit false, misleading, abusive, defamatory, infringing or unlawful content through any form;
• use the booking form for spam, advertising, or enquiries that are not genuine;
• impersonate any person or misrepresent your connection with any person or organisation.

05Inner Circle email sign-up

Joining Kevin’s Inner Circle is voluntary. It requires you to confirm your email address, and you can unsubscribe at any time using the link in any email. The emails are provided as information and encouragement, and their frequency and content may vary. How your email address is handled is described in the Privacy Policy.

06Booking requests

A booking request is an enquiry only. Submitting the form on the Book Kevin page does not create, confirm or guarantee a booking, appearance, engagement or contract of any kind.

A booking is confirmed only when it has been agreed in writing directly with Kevin Downswell or an authorised representative. We may decline any request, or choose not to respond, at our discretion. Nothing on the site is an offer capable of acceptance, and no contract is formed by submitting or acknowledging a request.

07Third-party links and services

The site links to and relies on third-party services, including streaming platforms, social media, online booksellers, a separate giving page, and the providers that power the email sign-up and the booking form (Kit and Formspree). We do not control these services and are not responsible for their content, availability, accuracy or practices. Your use of any third-party service is governed by that service’s own terms and privacy policy.

08Disclaimers

The site and all of its content are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including any implied warranties of accuracy, completeness, merchantability, fitness for a particular purpose, or non-infringement.

Devotional, ministry and other written content on the site is offered for encouragement and general information. It is not professional advice of any kind — legal, financial, medical, or counselling — and you should not rely on it as a substitute for advice from a qualified professional.

09Limitation of liability

To the fullest extent permitted by applicable law, Kevin Downswell Ministries will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, revenue, goodwill or opportunity, arising out of or in connection with your use of, or inability to use, the site, or your reliance on any content on it, whether based in contract, tort, or any other legal theory, and whether or not we have been advised of the possibility of such damages.

Nothing in these terms excludes or limits any liability that cannot be excluded or limited under applicable law.

10Indemnification

You agree to indemnify and hold harmless Kevin Downswell Ministries from any claims, losses, liabilities, costs and expenses (including reasonable legal fees) arising from your breach of these terms, your misuse of the site, or your violation of any law or the rights of a third party.

11Changes to these terms

We may revise these terms from time to time. When we do, we will update the “last updated” date at the top of the page. Your continued use of the site after a change takes effect means you accept the revised terms. If you do not agree to a change, please stop using the site.

12Governing law

These terms, and any dispute arising out of or in connection with them or your use of the site, are governed by the laws of Jamaica. You agree to submit to the exclusive jurisdiction of the courts of Jamaica in respect of any such dispute.
